By accessing or using the Services, you agree to comply with this Policy in addition to our Terms of Service.

Send An Oops is designed to help customers handle forgotten, delayed, or awkward gift-giving moments. The Services may not be used to deceive, threaten, harm, exploit, defraud, or unlawfully impersonate another person or organization.

2. Your Content & Materials

For purposes of this Policy, "Materials" means any content or information that you submit, upload, generate, create, store, transmit, print, link to, or otherwise use in connection with Send An Oops.

Materials may include:

  • Card messages.
  • Recipient and sender names.
  • Images and photographs.

  • Logos and trademarks.
  • QR-code destinations.
  • Links and URLs.
  • AI prompts.
  • AI-generated or AI-assisted content.
  • Uploaded files.
  • Other personalized content.

You are responsible for the Materials you provide and for ensuring that you have all rights and permissions necessary to use them.

3. Prohibited Activities

You may not use Send An Oops to create, upload, generate, distribute, ship, transmit, or otherwise facilitate Materials or activities that:

  • Are unlawful or facilitate unlawful activity.
  • Are fraudulent, materially deceptive, or intended to obtain money, property, credentials, or information through deception.
  • Harass, bully, threaten, stalk, intimidate, or defame another person.
  • Promote hatred, discrimination, or violence against a person or group based on protected characteristics.
  • Exploit or sexually abuse children or otherwise depict minors in an unlawful sexual context.
  • Promote, glorify, or materially assist terrorism or violent extremist organizations.
  • Encourage or meaningfully facilitate suicide or serious self-harm.
  • Infringe another person's intellectual property or privacy rights.
  • Contain malware, phishing content, malicious code, or other harmful technology.
  • Attempt to interfere with, damage, disable, overload, or gain unauthorized access to our Services or systems.

4. Impersonation & Deceptive Representations

Send An Oops may allow personalization of names, messages, packaging elements, labels, or other Materials. These features may not be used in a manner that falsely represents that a package, message, product, or communication was actually sent, authorized, endorsed, or issued by another person or organization.

You may not:

  • Impersonate another person, business, government agency, carrier, financial institution, or organization for fraudulent or harmful purposes.
  • Create Materials designed to appear to be an authentic communication, receipt, invoice, shipping notice, legal document, financial document, or official notice from an organization when it is not.
  • Use Send An Oops to falsely claim that a third-party brand shipped, sold, sponsored, endorsed, or authorized an order.
  • Misrepresent the origin, sender, contents, value, or purpose of a shipment in a way that violates law or carrier requirements.
  • Use another person's identity to deceive recipients or obtain a financial or other improper benefit.

A note about parody and humor

Lighthearted parody may be allowed where lawful and where it is not reasonably likely to mislead someone into believing the content is an authentic communication from an unaffiliated person or company.

5. Intellectual Property

You may not use Send An Oops to upload, print, display, reproduce, distribute, or otherwise use Materials that infringe or misappropriate another person's copyright, trademark, trade dress, patent, publicity right, or other intellectual property right.

This includes unauthorized use of:

  • Company logos.
  • Product packaging.
  • Brand artwork.
  • Copyrighted photographs or illustrations.
  • Characters or other protected artwork.
  • Trademarks used in a misleading manner.

Using a company's name merely because a personalization tool technically allows you to enter it does not grant you any right or license to that company's intellectual property.

We may remove Materials or refuse orders where we reasonably believe intellectual property rights may be infringed.
